‘I Will Honor The Agreement’ List Of Properties Babu Owino Promised DJ Evolve After Being Set Free

After several months of DJ Evolve being hospitalized after being shot by Embakasi East MP Hon. Babu Owino, the court has now allowed Babu to go scot-free & resolve their issue out of court.

Babu Owino expressed gratitude to the court for allowing him to solve the matter with the popular Disc Jockey out of court. Additionally, he thanked the DJ for the gracious manner he accorded to him during the challenging times before affirming his commitment to honouring the agreement.

He shared on his Instagram;

“I welcome the recent decision of the Senior Principal Magistrate Ochoi in which the court allowed DJ Evolve and I to resolve matters while embracing Alternative Dispute Resolution. I thank the court for being bold enough to uphold the restorative principles of Justice enshrined in the Constitution of Kenya 2010.”

In his statement, he also connoted that he will live up to the agreement that they had upon withdrawal of the case; which includes buying him a house.

”DJ Evolve is a brave and inspirational young man. I remain indebted to him for the gracious manner in which he has carried himself during this obviously challenging time.

We were close friends and have become even closer through this Damascus moment and I am committed to honoring my part of the agreement.”

The other provisions include;
Clear the Ksh 17 million hospital bill.

Buy a Noah and customize it for DJ Evolve.

Buy a house for DJ Evolve and register it under his name and that of his parents.

Build the DJ another house in Utawala.

Set up a DJ Academy.

Pay nursing costs until DJ Evolve recovers.

 

Babu Owino delivers good news on DJ Evolve’s health (Interview)

Last time we checked, DJ Evolve’s dad confirmed he was responding well to treatment but it now emerges he has been discharged.

The B-Club deejay has been through three surgeries after which his recovery showed positive signs despite a ballooning hospital bill.

Fortunately, we can now confirm that DJ Evolve might be getting back on deck once this entire Coronavirus crisis is over and done with.

Sharing intimate details with media personality, Jalang’o, Babu Owino stated:

I am the one who is paying the bills.

Further confirming Felix Orinda’s discharge from hospital, though not entirely.

And infact as we speak, DJ Evolve has been discharged from the hospital. He is just waiting to be taken home. The reason he has not been taken home is because of the Corona situation.

In the face of the lethal Coronavirus, strict measures need to be put in place to ensure the entertainer gets back home and safe.

Things might be bad on the way, or at home, you know the interaction so that is what the family is working on.

However, the legislator said he was still in communication with the family. Clarifying that he was not in the business of sticking to his past, rather focus on his future.

We are in communication with the family and Jalas what I must say: Number one, there is no saint without a past. Number two, I would not like to dwell on my past so much because I can’t change my past, but I can change my future.

Reiterating that what happened is between him and God.

So I would like to talk about my future, ‘what is going to happen in the foreseeable future?’ Then every other thing that happened, is between me and God.

New High Court ruling lessens Babu Owino´s bail terms

Tuesday, the 3rd of March, the high court relieved Babu Owino of half his cash bail and challenged his payment of DJ Evolve´s hospital bill as misplaced.

The Embakasi East MP´s wishes had finally come to reality after High Court Judge, Luka Kimaru ruled that the politician should not be forced into paying the DJ´s hospital bill.

According to the judge, payment of the entertainer´s pending bill should be considered a moral obligation and not forced on him by any means.

The accused person should continue paying the hospital bill as a moral duty to him, not as a court order. If he fails to pay, it is up to him and his God.

Further stating that payment of the hospital bill by the legislator does not in any way imply that he was guilty of the attempted murder charges.

Speaking to Kenyans.co.ke, Babu Owino admitted that the hospital bills are not a walk in the park, sharing:

It is a little too much, but I will continue paying the bills.

So far, a payment of Ksh 4.4 million has been made according to the bail terms, with a remaining Ksh 600,000 that will see him get remanded until it is cleared.

Re-consideration

On the 27th of January, the youthful MP had applied for a cash bail reduction, seeking an alternative bond.

In an application filed to the court, Babu revealed that it was proving difficult for him to meet the cash bail terms, being a little too hefty for him.

I have partially compiled with the terms as set out and thus I am out on bail but I know that I thus would also appreciate an and above a reduction of the amounts stated being Ksh 10 Million.

Just to clarify, the Embakasi East lawmaker stated that paying the DJ´s hopital bills, does not in any way mean that he is guilty of the shooting.

Despite the fact that I had voluntarily started assisting the victim in meeting the medical expenses and had pledged to voluntarily continue doing so, at no point was it to depict an admission of guilt as the Court seems to have depicted. Thus, the same should not be used to render high or punitive bail terms.

Babu Owino is currently walking free after he was released yesterday on a 10 million cash bail and ordered not to take any alcohol!

This comes a few days after he shot DJ Evolve at B Club over an unknown matter. Well, DJ Evolve is still fighting for his life at the Nairobi Hospital where he has undergone several surgeries so far.
