Eric Many wins N14 Million lawsuit case for Runtown

A case of three years but Eric Many and Runtown finally win the lawsuit case filed by the Dynamics mind league in Anambra state for failure to show up for their 2015 carnival.

“The case, Suit No LD/ADR/251/2015, was filed on 19th August, 2015 by the Anambra group through its leader, Mr. Chizuo Anetoh. They dragged Runtown, Ericmany Entertainment and Prince Okwudili Umenyiora, the billionaire Chairman of Dilly Motors Limited and Ericmany Entertainment before the Lagos High Court, claiming the sum of N14 Million as damages for failure of Runtown to perform at their Harmattan Carnival held at Adazi-Nnukwu, Anaocha in Anambra State.

 

Ericmany lawyers, Chijioke Emeka & Colleagues [Auxano Law] argued that the group first breached the contract having failed to provide all that was required and in good time for the artiste to make the appearance. Ericmany’s case was that the group made inadequate and shoddy arrangements. Being the Christmas period, Ericmany’s crew had to sort out late hour flight tickets to Port Harcourt instead of Asaba or Owerri nearer to the Anaocha venue. Upon landing in Port Harcourt it was late to proceed on a dangerous night road journey without adequate security, Ericmany’s lawyer claimed.

 

During the trial on 10th May, 2018, Mr. Aneto testified for his group. He narrated how Runtown flew from Lagos to Port Harcourt but refused to further proceed on the road journey to Adazi, even after they engaged a police escort for him at the airport. Ericmany’s witness, Amani Henshaw gave an account of the breaches of the contract by the group, especially its failure to provide flight tickets for the crew and failure to provide sufficient security for the night road journey to Anambra State.  He told the Court how his team waited for many hours at the airport until it became very late and they had to cancel the trip.

 

In his judgment, Hon. Justice K. O. Alogba gave victory to Ericmany. The Judge found that the failure of Runtown to get to Adazi in Anambra State and perform at the carnival was justified as the group’s arrangement was very shoddy. The Court agreed with Ericmany that the Dynamic Minds League was reckless about the contract when it failed to book flight tickets ahead. The Court also held that the group did not prove how they are entitled to their N14 Million claim as it did not adduce cogent evidence. Each of the claims was therefore dismissed.

 

Justice came the way of Ericmany Entertainment barely three years after the Dynamic Minds League flooded the print media, social media and several blogs with news of the alleged breach of contract and its N14 Million suit against Ericmany”

Celebrities React to Runtown’s Bizarre Pet

Yesterday, singer, Runtown took to his Instagram page to show his new pet to his fans who were not much humoured by his choice.

In the post which revealed that the singer had gotten himself a lion, mixed reactions follow in the comments section.

Celebrities like Davido, Phyno, Emma Nyra, Simi and others were however, among those that reacted to the post.

In what looks like a note of caution, Phyno tells the singer that he is looking for trouble.

Singer, Runtown Seeks Help with his New Pet, a White Lion

Nigerian singer, Runtown, has acquired something very spectacular for himself and it has got people talking.

In a post shared on his Instagram page, the singer unveil his newest pet, a white cub.

Runtown wants suggestions on what to call his pet.

Sharing a video of himself feeding his pet, the singer introduced the animal to the world. He however asks that people should help him with a suitable name.

He wrote:

 Say hi to my pet Lion. What should we call him? ?

A lion is a wild animal of the cat family, feared by almost every other creature including man. The closest people get to a lion is during a visit to a zoo or when on a Safari trip to East Africa, in wildlife parks.

Celebrities like Wizkid who got himself a goat as pet last year, have surprised people with their choice but who thought a lion will ever be considered a domestic animal?

Runtown Reacts to Fraud Allegations Against him

Yesterday, a US based woman made a viral video accusing singer, Runtown of defrauding her. (Read here). The singer has now, through his management, responded to the allegations.

According to him, Runtown is in no way associated to the said woman. They have however, contacted security agencies (DSS and EFCC).

Preliminary investigations by the security agencies has therefore revealed that the woman fell prey to internet fraudsters. They are a group that used the singer’s name to defraud the woman, he said.

Runtown’s management’s statement below;

Our attention has been drawn to reports circulating on social media by a US based woman named, Shawn Rene accusing our artist, Runtown of fraud.

‘Its all lies and and an attempt to blackmail and tarnish our image. We have contacted the Nigerian security agencies including the DSS and EFCC who are all on the matter at the moment and preliminary investigations already reveals that its a group of impostors who may have duped ‘Sawhn Rene’ using Runtown’s name.

Runtown has never and will never defraud anyone.

A woman identified as Shawn Rene as thrown a fraud allegation on Nigerian singer, Runtown. Shaw who is a US-based said the singer and his brother as defrauded her and her fiancee. She also shared the screenshot of their transactions. But LIB reached out to Runtown’s management and they claim it’s a blackmail.

Shawn wrote: ‘I wrote him two checks in two companies name, $32,000 and $107,000, after he got the checks and cashed he started saying stories, later on he started saying they would pay after runtown’s show in Canada, I and my fiancée couldn’t have it because, we never invested on anyone’s music, I even had to come down to Kenya just to be certain my fiancée wasn’t involved, and even arrested the Alex, and after investigations and all we found out it was jack, his brother and wife trying to play a fast one on us, his wife claimed they had the money returned to me, which I also have the record of’.

She went on to say, ‘I and my fiancée has used over $18,000 for both legal fees tickets and hotel bills already, he had to even travel to Nigeria to make a report also. This past months I have been dealing with cancer and chemo and catching flights from Texas to New York regularly just as result of my fiancée trusting his fellow country man so much. I gave this people $107,000 and they only paid $150000 to my fiancée. Above was when jack got the check, and also a 3 way call with him Alex and my fiancée’.

Recently there has been a tide between Runtown and his record label, Eric Many after he left his record label.

As carried on LIB,  a statement was released by Eric Many that says, ‘recall that we served a Contempt Warning from Court on Runtown on 4th July, 2018 after he defied Court Order and released a song. Rather than heed the Contempt Warning and retrace his steps, he issued a Press Release in which he argued that the Injunction had expired. The Injunction was to stop things until the hearing of our Motion seeking to freeze activities until a decision on his status (whether he had discharged his obligations to us or not) is taken. It barred him from performing or releasing songs for the time being’.

The statement went on to add that, ‘the legal advice we received was that Runtown was wrong in his interpretation of the Rules of Court he relied on since he was already served with our Motion and was represented in Court on 31st May, 2018 when the Court adjourned to 27th September, 2018 to hear the Motion and the one filed by Runtown himself! To turn around after that day to proceed to do what the Order barred him from doing, and what the Motion served on him (adjourned in his presence) seeks to stop, is unjustifiable under the 7-Days Rule he relied upon. That could probably apply to a person against whom an interim injunction was obtained without more’.

‘Based on this, we have done two things: One, we have obtained a ‘FORM 49’ against him to explain why he should not be sent to prison, especially when he continued to publicize fixtures for shows in Canada, Namibia, Europe etc and threaten to release more songs, both actions in defiance of the Court Order. The application (now fixed for 8th August) has been served on him in the Punch as ordered by the Court. Two, since we will not allow him to continue to mock the Court Order we have applied and obtained a new Injunction to stop his actions to protect the Contempt Case. The new injunction bars him from his threatened defiant actions in Canada, Namibia, Europe etc. We believe the new Injunction has not also ‘expired’ and hope he respects the Court this time. 

 

Please bear in mind that our main case in Court boils down to whether Runtown has discharged his monetary obligations to us and delivered one Album to us as spelt out in our Contract. He has responded, so it will be good to allow the Court to decide what each party filed. Let both sides apply restraint. As we always say, Ericmany Limited will continue to follow the judicial process. We have confidence in the Rule of Law and will continue to patiently follow the due process until the wrong done to us by Runtown after our heavy investment on him is redressed’.

Below is a statement released by singer Runtown also known as SoundGod as he parts with  record label, Eric Manny.

Despite numerous breaches of the Recording Agreement by Eric Many, which would make it invalid and unenforceable, the Agreement entered into on June 21, 2016 officially came to an end on June 22, 2018.

Pursuant to Section 6.5 of the Agreement, “The Parties agree[d] that the Artist is and remains the owner and lawful proprietor of the Professional Name and the Artist’s likeness.”

Eric Many was only entitled to use the name Runtown throughout the duration of the contract, and for a period after termination of the contract for the promotion and sale of music.

Eric Many does NOT own the name “Runtown” or “Soundgod,” and is NOT entitled to trademark, copyright or use the name without the explicit consent and approval of the artist. Public use of the name Runtown began in 2008, before the signing of any contract with Eric Many.

Further, there is NO court order currently enjoining or preventing Runtown from singing, performing or recording music. Please be advised that the interim injunction granted by the High Court of FCT against Runtown on 10 May 2018, has now expired by effluxion of time pursuant to Order 43 Rule 3(2) of the High Court of the Federal Capital Territory, Abuja (Civil Procedure) Rules 2018. The said injunction became ineffective on the 17th of May, 2018.

To date, Eric Many has filed two frivolous law suits against Runtown. On May 24, 2018, Eric Many withdrew the initial frivolous lawsuit it filed in Lagos, Nigeria after realizing its claims could never be proven. The Lagos court ordered Eric Many to pay Runtown’s costs associated with that suit.

Interestingly, instead of adding any new claims to the Lagos suit, Eric Many filed a new law suit in Abuja, Nigeria, while the first law suit in Lagos was still pending. The second lawsuit abandoned all of the claims made in the first law suit, and claimed that Runtown owed an unconscionable amount of money to the record label.

Eric Many has yet to show any reliable proof or records of its claims. Instead it has only provided Runtown with a loosely composed accounting that shows fraudulent figures, unsubstantiated expenses and zero financial responsibility on the part of the record label.

In short, the record label placed all financial responsibilities, including the costs of all travel, regular business expenses and even legal fees of the label on Runtown.

All expenses of running the record label were charged to the artist, which is a clear breach of the recording agreement that requires the label to shoulder such costs.

Runtown filed suit against Eric Many in New York for breach of contract, unpaid royalties and defamation. On May 25, 2018, the New York State Supreme Court Judge ordered Eric Many to continue to pay royalties to Runtown for the distribution of his music in the United States. Eric Many is in violation of that order, having paid Runtown nothing since February 1, 2018.

We are confident that after this matter is properly litigated in Nigeria and the United States, it will become evident that Eric Many did not only breach the recording agreement severally and abuse its power, but that it has been fully reimbursed for its initial investment and is currently indebted to Runtown for unpaid royalties and revenue. One cannot seek relief from the same contract which it has repeatedly breached.

Runtown is not in the business of breaking contracts. We want to assure all fans and supporters that for as long as God shall allow, Runtown is and will continue to be focused on making, sharing and performing good music worldwide.

“I don’t have beef with Runtown”- OAP Yaw Naija

Yaw says he has spoken with Runtown about the viral video.

Last week, popular OAP, Yaw Naija took to social media to vent his displeasure over singer, Runtown.

According to him, he was mad at the singer because he ditched his show last year. He had invited the Mad Over You singer to his show but was turned down on the excuse that he would be outside of the country at the time of the show.

He was however hurt when he found out that the singer was lodged in Eko Hotels on the night of the show; the same venue where the show happened.

This was in an interview with Sunday Scoop, where he noted that the singer had reached out to him after the video went viral.

Excerpts below;

The truth is I don’t pay attention to social media. I was just having a conversation with my friends in the studio and we were doing ‘Instagram live’.

If you had listened to the footage well, you would hear Runtown’s song playing in the background. If I still have issues with him, I wouldn’t have played his song.

He sent me a message on Wednesday morning after seeing the video and we spoke.

“I am human. Even when I was not happy with Runtown, I was still promoting his songs.

I have been talking about national issues such as the Plateau killings and the need for people to get their PVCs, but people decided to ignore all that. It was the part I talked about Runtown they paid attention to.”

Yaw said since he started organising shows 10 years ago, Nigerian artistes such as Olamide, Davido, Wizkid, Tiwa Savage, Reminisce, Phyno and many others had been supportive.

He added, “I have enjoyed great support from Nigerian artistes. But I called Runtown three years ago and he said he was not available. When I told him two years ago, he still claimed not to be available.

But for last year, he promised he would come if he was in town. On the same day, the Lagos State Government held a concert at Bar Beach. He attended and lodged at Eko Hotel.

Humblesmith performed at Bar Beach too but still came to support me. I expected Runtown to show me support and leave.

“When I saw his car, it was normal for me to feel bad. But afterwards, I forgot everything. I don’t think anyone has played Runtown’s song, Mad Over You, like I did.

If you know me well, you will know I don’t have time for things like this.”

Runtown served an injunction by his Record Label over breach of contract

Eric Many, the record label that signed Nigerian popstar, Runtown has filed an injunction at a Federal High court against the singer for breach of contract. This will be his second time in 2 years.

The entertainment company served Runtown the court papers a few days back with Suit No: FHC/L/CS/267/2018 with a statement that partly reads, ‘Runtown has been deliberately breaching his contract with us (Eric Many) for a while and despite our many appeals to him he has refused to bulge. He went for a show in Las Vegas since January 13th, 2018 and has since decided to withdraw all obligations of his contract. He has steadily been recording an album without the consent and approval of his record label’.

According to the statement of claim filed at the Federal High Court, by Eric Many, “a Recording Agreement was made between the Plaintiff and the Defendant dated 22nd June 2016, the copyright and other intellectual property and cognate rights and legal positions and protections applicable to all works done by the Defendant during an initial period of two years covered by the Agreement, is vested in the Plaintiff. The Plaintiff will rely on a copy of the said Recording Agreement at trial. 7. Under the Agreement, parties recognize and acknowledge the sum of N114,456,670.00 (One Hundred and Fourteen Million, Four Hundredand Fifty Six Thousand,Six Hundred and Seventy Naira) as “Prior Investment”, representing the sum invested by the Plaintiff into the development of the Defendant’s musical works and records under the defunct ‘Artiste Agreement’, precursor to the ‘Recording Agreement”.

In a press statement issued this morning, the label also states that, “he’s recording with artists like Del B without the written approval of the label and without an Eric Many appointee at the point of recording as agreed in our contract. Runtown has also been appearing in venues and collecting appearance fees without the approval of the label and also performing in private shows without the label’s consent which contravenes clause 4.4.1 of  his record deal which states that ‘the Defendant(Runtown) can only engage in recording, collaborating or performing with other artistes for third parties or other record companies upon proper notification in advance to the Plaintiff. Upon this notification, the Plaintiff would then enter into an agreement with the collaborating artiste or his record company to ensure that the Plaintiff and the Defendant receive proper credit, legal/copyright protection and compensation for the collaborative work”.

Mr Easy is yet to see the last of Nigerian keypad warriors after he said Nigerian artists copy Ghanaian music style.

Banku Music pioneer, Mr Oluwatosin Oluwole Ajibade, a Nigerian singer with the stage name Mr Eazi claimed that Nigerian artists are now found of using Ghanaian lexicons while recording their music.

In an interview with Capital Extra Mr Eazi said, 70% of Nigerian artist come to Ghana every year playing shows using words like: shitton, Mami, Sika, Oddo, Banku on shows and in the studio.

He also claimed that most African Afrobeat Hiphop stars are all on the Ghana-Nigeria merger emphasizing with much relevance on Ghanaian music over Nigerian artist.

In his words, “The speed at which I’ve moved is scary to me…cause it took my contemporaries five, six years, and that is what has been this year, if you want to count like five afrobeat, it’s like everybody just realized that ‘yo what formula is Mr Eazi using?’ Ok we’re gonna end up doing it. December last year almost 60% of Nigerian artiste were in Ghana playing shows”

Eazi in an attempt to discredit the use of Ghanaian ele3ments in Nigerian Music went further to say, “It’s just like an American artist just rapping about something in the UK, and you know he has no knowledge of it.”

His statement has encountered reactions on twitter with many downplaying him for being an ingrate and not having fair respect for Nigeria which is the major entertainment hub of Africa.
