“I notice some rashes on my private parts” Man sues KEBS and Beta Healthcare after condom burst during sex making him contract STI

A daring man has moved to court to sue Kenya Bureaus of Standards (KEBS) and Beta Healthcare after he contracted Sexually Transmitted Infection (STI) due to condom burst.

In his petition, the man says he believed he would please his mistress and also protect himself fully but the condom broke during the act.

“That on or about Monday, October 13, 2014, I began to notice some rashes on my private parts and pain while urinating. That I became extremely worried and it was then that I remembered the condom burst that had taken place 9 days earlier. I immediately went to a traditional healer and sought some traditional herbal medicine which eased my pain,” said the man in the affidavit.

Wife left him

The man says that his wife left him after accusing him of infecting her with STI. He further reveals that he sunk deep into depression and even lost his job after his wife dumped him.

“That on 17th, my wife called and informed me that she had been admitted with an STI. My wife blamed me for being unfaithful and our relationship was strained afterwards. My wife then became estranged and later left me for another man. After my wife left me, I became distressed burdened with guilt and even had a mental breakdown which led me to be an alcoholic and I lost my job,” the affidavit read in part.

The man claims that he was later told by his friends that some of them had experienced condom breaks from the same brand of condoms.

The plaintiff identified the batch number of the condom he used that fateful day as DH1102 which had been labelled on its packet.

“I became distressed and burdened with guilt and even had a mental breakdown which led me to be an alcoholic and eventually lost my job. I was told by some friends they had experienced condom bursts from same brand making me doubt the quality of the brand.

“I was fully aware of the dangers of having unprotected sex and decided to use my favourite brand of condoms being the Zoom, scented, chocolate flavoured studded condoms which I believed would please the woman and protect me fully. That whilst I was having sexual intercourse with the woman, the condom broke, a fact which I only realised after the act.”
