The new tax proposal will push away gaming companies from Kenya, if its implemented

The Ministry of Finance is seeking to reintroduce excise duty on betting at a rate of 20 percent of the amount staked.

This means total taxes would exceed 86.5 percent, which could again bring closure of some betting firms due to the unfavorable working environment.

In turn, Kenya would be left without great income and thousands of people that work in this industry would lose their jobs.

Here is a list of all the taxes that betting companies would have to pay:

20 percent Excise Tax on betting stake
1.5% Digital service tax on betting tax
15 percent Betting Tax
Tax on winnings 20 percent
Income tax 30 percent

Additionally, the return on investment in Kenya through the payment of profits/repayment of loans would be subject to additional taxation in Kenya, which would lead to the situation that due to the applied tax policy, doing business in Kenya would not be commercially viable.

Reintroducing excise duty on betting, total taxes would exceed 86,5 percent. The negative effects of stringent measures could again bring closure of some betting firms

Foreign companies describe the Kenyan market as an over-taxed and unfair operating environment.

The companies in the industry are already paying high fees, and additional taxes are being proposed, which do not exist in Europe or America.

In England, the tax on the difference is 20 percent, and there is no tax on winnings or stake, Kenya would be one of the few countries in the world to adopt this model of taxing the gambling industry.

Excise duty on betting was introduced in 2019 but was removed in July last year.

One of the reasons behind removing the tax was that the high level of taxation had led to punters placing bets on foreign platforms that were not subject to tax and thereby denying the government revenue.

Parliament scrapped the excise tax saying that it is meant to reverse the negative effects of stringent measures that included the closure of some well-known betting firms.

That closure led to job losses for hundreds of Kenyans and a revenue gap to the taxman who had annually collected billions of shillings in taxes from the betting industry.

Gaming companies are big sponsors of Kenyan sports and generally have a great impact on the community.

They have especially stood out with donations during the coronavirus pandemic.

Mozzart donates PPEs worth Ksh 2 MILLION to Iten County Referral Hospital

Leading gaming company continues to provide support to Kenya’s healthcare, making numerous donations to different hospitals every week. Helping the Kenyan healthcare system is one of Mozzart’s priorities in terms of socially responsible work. Accordingly, the organisation on Tuesday 16 March donated Personal Protective Equipment (PPEs) worth Ksh 2 Million to the Iten County Referral Hospital.

The goal of the action is to improve the working conditions of health workers and establish support for the community.

At hand to receive the donation was Elgeyo Marakwet County Governor Alex Tolgosapprecaite who thanked Mozzart.

’’We are happy to welcome Mozzart to the great county of Elgeyo Marakwet. Kenya is currently in the third wave of COVID-19 infections and these PPEs will go a long way in helping us fight this pandemic,“ he said,

’’Health is very important and I want to thank Mozzart for what they have been doing in various facilities around the country. Health is definitely an area that needs support and Mozzart has been at the forefront of helping citizens since this pandemic started. This is commendable,“ he added.

Mozzart Country Manager Sasa Krneta said the organization would continue supporting community projects around the country.

“I am very delighted to be here today with my team from Mozzart to share with you these donations from our organization. Covid-19 has slowed down most sectors of the economy globally and it is important that we all stand united in the fight against this pandemic,“ he said,

BCLB officials risk jail for contempt of court

As of Sunday, December 20, 2020 officials of the Betting Control and Licensing Board (BCLB) risk being jailed for violating court orders barring them from interfering with the operations of the popular gaming platform SportPesa.

Court order keeps SPORTPESA paybills on as battle for the brand rages on

This is after Milestone Games Limited, the company that operates the SportPesa brand in Kenya, moved to court seeking to have BCLB Chairman Cyrus Maina and six other board members jailed for contempt of court.

In the latest twist in the ongoing legal battle between SportPesa and BCLB, Milestone claims the seven officials have deliberately disobeyed orders issued by the High Court on December 3 despite having been served with the same.

BCLB wrote a letter to Milestone on December 4, even after High Court judge Pauline Nyamweya barred the betting regulator from taking any further action, directing the company to show cause why its bookmaker’s licence should not be cancelled.

In the court papers served on BCLB and other parties in the suit, Milestone claims that continued interference in its operations and business is a mockery of justice and now wants the betting officials jailed for six months.

POWERFUL LOCALS DESTROYING THE KENYAN ECONOMY, DRIVING AWAY FOREIGN INVESTORS

“The action to belittle and disregard court orders at will cannot be taken lightly and should be arrested at the earliest opportunity,” reads the application filed in court.

Other BCLB board members named in the proceedings are Peter Mbugi, Peter Kanaiya, Paul Njaga, Sabrina Kanini, Joy Masinde and Daniel Koech.

CONSPIRACY AGAINST FOREIGN INVESTORS?

Milestone further wants the BCLB chair and board members barred from holding public office as long as they continue disobeying the court orders allowing SportPesa to continue operations pending the hearing and determination of the case.

In a supporting affidavit, Milestone further states that BCLB bosses have “demonstrated utter disdain for court orders and the judicial process” despite being served with the orders and penal notices asking them to purge the said act of contempt.

“That the act of the Respondent and its Board Members is of utter utmost contempt of court and demonstrates disrespect to the Honourable Court and the same should not go unpunished,” states the affidavit.

This week, BCLB and ministry of interior officials went to SportPesa offices in Nairobi in what amounts continuing violation of the court orders allowing the gaming platform to continue operating in Kenya.
