Kevin Kang’ethe, a murder suspect sought by US authorities, has contested his imprisonment at Industrial Area Prison Remand, alleging it infringes upon his rights.

Represented by his attorney John Maina Ndegwa, Kang’ethe argued that his detention was unlawful and petitioned the court for intervention.

Initially held at Muthaiga Police Station, Kang’ethe’s detention period lapsed on February 29, 2024. However, the prosecution did not seek an extension, resulting in his transfer to Industrial Area Prison.

Ndegwa stressed that the court had initially ordered Kang’ethe’s detention at Muthaiga Police Station for 30 days, a period not extended. Consequently, his current confinement is deemed illegal.

He requested 21 days to scrutinize documents pertaining to Kang’ethe’s extradition to the US, along with access to his client and case file.

In response, prosecutor Magdalene Nduati cited Kang’ethe’s misconduct as the reason for his relocation to Industrial Area Remand prison, citing heightened security.

The magistrate granted Ndegwa’s 21-day request to review the documents and directed the prosecution to furnish the defense with necessary paperwork.

Any decision regarding Kang’ethe’s release was deferred until bail and bond matters are addressed, with the magistrate ordering him to remain in Industrial Area Remand prison.

Further proceedings were scheduled for April 4, 2024.
