Leading Nairobi Hotel Ordered to Pay to Play Music

From now henceforth, Nairobi Pacific Hotel, a 3-star hotel, will have to part with cash for public sound recordings and audio-visual works.

In a landmark ruling by Hon. Gichobi at the Milimani Law Courts, Kenya Association of Music Producers and Performers Rights Society of Kenya (KAMP-PRISK) got an important victory over Nairobi Pacific Hotel Ltd.

The hotel had filed an injunction to restrain KAMP-PRISK from collecting fees for the Communication to the Public License, a joint license issued by the two organisations to entities that communicate to the public sound recordings and audio-visual works.

The magistrate dismissed the application with the plaintiff being ordered to pay for the legal costs
