After termination of MCSK’s license, Kenya Copyright Board steps in to offer relieve for all Kenyan Artists…The future surely looks bright

Kenyan artists can finally breathe a sigh of relief and this is after, Kenya Copyright Board stepped in to save the day.

As you are all aware, Music Copyright of Kenya (MCSK) which is charged with the responsibility of collecting royalties for all artists in currently not in operation and this is after their license failed to be renewed for this fiscal year.

As exclusively revealed here on Ghafla, they failed to submit the required audited accounts for them to continue being in operation.

This it comes out was a blessing in disguise for artists as the Kenyan Copyright Board (KECOBO) has taken this opportunity to organize forums for the public to finally come out and discuss what exactly they require from Collective Management Organizations (CMO’s).

The objective of this undertaking is to create a workable Collective Rights Management Regulatory framework that promotes transparency, accountability and good governance among Kenyan Collective Management Organizations (CMOs).

At present, there is no regulation that guides the promotion of the values of Transparency, Accountability and Good Governance in the Collective Management industry. If you can remember very well, one of the biggest setbacks that always befell MCSK was accountability and allegations of embezzlement.

The introduction of this regulation shall definitely improve the operations of CMOs through enhanced supervisory structures. It will set in place statutory parameters and standards for assessing the performance of CMOs as well as conditions and procedures under which a CMO can be put to task to prove its commitment to upholding the required standards of service delivery to its members/rights owners.

With proper laid down structures on dealing with CMO issues, the oversight body shall have effective and efficient means of addressing complaints and concerns raised in the industry and this will curb the excessive politicization of concerns raised by stakeholders case example the issues that were brought about by Elani the other day.

That time has finally come and all stakeholders are being called upon to be actively involved in deliberations and finalization of the draft before adoption.
