An appeal will be filed by the Director of Public Prosecutions’ office against a High Court ruling that cleared former TV News presenter Jacque Maribe of any involvement in the entrepreneur Monica Kimani’s death.
In their notice of appeal, the DPP states that they would be appealing a portion of the ruling that freed Maribe because they disagree with trial judge Grace Nzioka’s decision to acquit her in the murder case.
He will be sentenced on March 8 and is presently being held at Industrial Area custody.
According to Judge Nzioka, Maribe was acquitted because the prosecution neglected to identify her as being present at the scene of Monica’s murder.
Maribe was cleared by Nzioka, who stated that there was no proof Maribe had ever spoken to Monica.
She criticized the prosecution for picking the incorrect accusation to bring against her.
“I firmly believe that the charge filed against Maribe was inappropriate. The judge stated that Maribe’s evidence did not show that she was in the deceased’s home on a significant night.
Nzioka claimed that the evidence used against her was limited to the gunshot event that happened on September 20 and involved Jowie. The court ruled that Nzioka was accountable for providing false information to the police in this occurrence.
