A petitioner has approached the court seeking a declaration that the traditional Akamba brews, commonly known as ‘kaluvu’ and ‘mawa’, are not illicit beverages.

Augustus Kyalo Muli, the national patron of the Anzauni Ndene Clan of Kenya, is advocating for his clan’s right to produce and consume these brews as part of their cultural heritage without interference from the state.

Through his lawyer Charles Mwalimu, Muli has requested the court to direct Interior CS Kithure Kindiki and Attorney General Justin Muturi to exempt ‘mawa’ and ‘kaluvu’ from licensing requirements within 30 days. He also wants progress reports to be submitted to Chief Justice Martha Koome.

Furthermore, Muli seeks a declaration that the regulation and brewing of these drinks solely fall under his authority as the National Patron of the Anzauni Ndene Clan of Kenya.

Man accused of HIV/AIDS infection of lady in court

The Director of Public Prosecutions (DPP) has requested a determination of the status of a man charged with knowingly infecting a woman with HIV/AIDS to enable appropriate charges to be filed.

State prosecutor James Gachoka emphasized the importance of extracting samples from the suspect and made the submission before Senior Principal Magistrate Bernard Ochoi at Milimani Law Courts.

“I urge this court to order specimen be extracted from the man (name withheld) for examination at a government laboratory before a proper charge can be preferred,” Gachoka stated.

“The charge against the accused is that of deliberate transmission of HIV contrary to Section 26 (1) of the Sexual Offences Act No.3 of 2006 whose maximum penalty is life imprisonment upon conviction.”

Gachoka mentioned that the police are yet to ascertain the HIV/AIDS status of the accused person and that a report of the accused’s status must be established before a trial date can be allocated.

He highlighted the seriousness of the offense, given that the suspect is accused of infecting the victim with a terminal disease.

Gachoka suggested that once the status of the accused person is known, there are high chances of amending the charge.

Earlier, he applied to have the case heard in camera to protect the integrity and image of the victim, who is also an adult. The magistrate granted the request to protect the victim’s reputation.

The accused person was ordered to be remanded at Industrial Area Prison until February 26, 2024, when the magistrate will decide whether the samples/specimen will be extracted or not.

The accused faces charges of intentionally, knowingly, and willfully having unprotected sex with a woman, knowing he was infected with HIV, between October 5, 2022, and June 30, 2023. The suspect has pleaded not guilty to the charges.

How a wanted American murder suspect left a police station while under arrest

Police have initiated a manhunt for a suspect awaiting extradition to the US on first-degree murder charges after he escaped from police custody under questionable circumstances. Kevin Kangethe Kinyanjui, 40, who was arrested in Nairobi’s Westlands area last week, escaped while meeting his lawyer at Muthaiga police station on February 7.

Pastor connected to the unexplained death of a woman discovered in a shallow burial

On Tuesday, January 30, a pastor was presented in the High Court in Nanyuki in connection to the 2018 murder of a woman whose remains were only recently discovered.

However, Pastor David Wagiita of First Pentecostal Church-Nanyuki, the prime suspect in the murder of Ruth Gathoni, did not enter a plea when he appeared before Justice Anthony Ndung’u.

The prosecution requested the court to adjourn the case, allowing the state to appoint a lawyer for the accused.

Murder is a capital offence, and suspects who cannot afford a lawyer are given legal representation funded by the state.

Judge Ndung’u ordered that the accused be brought before him on February 21 to be formally charged with murder.

Gathoni went missing on August 18, 2018, with the family telling detectives that she was last seen with Pastor Wagiita in Nyeri Town, boarding a matatu bound for Nanyuki.

Shortly after her disappearance, Wagiita was arrested and charged with kidnapping but was acquitted due to a lack of evidence linking him to the crime.

This prompted the family to embark on a frantic search for their lost loved one, which only ended on September 30 last year when construction workers at Muthaiga Estate in Nanyuki Town discovered a human skull in a shallow grave.
